PHOTOGRAPHIC RIGHTS AGREEMENT

THE FOLLOWING IS AGREED
Article 1 – Object
MSF herein acquire the rights to use an additional selection of photographs on the subject of
XXX taken in project YYY on the context of ZZZ on the following DATES.
The final selection done by the photographer, in collaboration with the MSF OCB Editor,
consists of XX photographic documents in colour/B&W, which shall all be delivered by the
photographer to MSF as JPG files with embedded captions at high resolution to MSF by
15/OCT/2009at the latest.
Article 2– Copyright
As the report is the result of spontaneous collaboration, the photographer non-exclusively
transfers to MSF, which accepts, the rights of reproduction and communication to the public
associated with the photographs delivered. XX images are valid for all MSF publications,
MSF websites, fundraising activities including exhibitions related to MSF activities. The
images will be added to the MSF international photo database, which is available throughout
the MSF movement and will clearly mention the limitation to MSF publications and
fundraising.
XX images will be available for all MSF publications, but will also be available for MSF to
send freely to external media worldwide. These images will be stated as for external media
and for social media on the MSF international photo database. MSF will do it’s best to
promote direct contacts between the photographers and the medias, but on topics for which
media interest is lacking, MSF will offer these images freely to medias.
In the event that an external party wishes to use images, MSF will endeavour to put them in
touch with the photographer or appointed agent to negotiate rights and payment. But MSF is
not a photo agency and cannot guarantee publication or contact between external parties and
photographer.
MSF expressly recognises that it is not the holder of the photographer’s moral rights, nor
copyrights. Consequently, the name of the photographer shall be mentioned in all
publications. With the mention © Photographer’s nam.
Article 3.1 – Fees
The fees for the purchase of rights to MSF publications & fundraising use images is set at 50
Euros before VAT per image. The fees for the purchase of rights to MSF external use images
(images that can be shared freely with media) is set at 100 Euros before VAT per image. For a
total agreed amount of XX Euros.

Article 3.2 – Invoicing
The photographer shall remit an invoice to MSF, payable at 30 days end of the month.
Article 4 – Special clause
The photographer confirms that he/she complied with the laws and regulations in force in
Country and lived in good understanding with the persons in the country at the time of capture
of the material. The photographer was not embedded with any armed or politically engaged
group during his/her visit of the area surrounding the MSF project locations.
Article 5 – Intuitu Personae
This contract is concluded intuitu personae.
Article 6 – Disputes
The courts of Brussels shall have sole jurisdiction over any disputes concerning this
agreement.
Done in two original copies, each party recognising by its signature that he/she/it agrees to the
above and is in possession of a copy.
