PHOTOGRAPHIC RIGHTS AGREEMENT

THE FOLLOWING IS AGREED
Article 1 – Object
MSF herein acquire the rights to use a selection of photographs taken between April 25 and
May 1, 2016 on MSF mobile clinics in Zummar in Irak. The photographs should illustrates
the project as per ToR # 201603.
The final selection done by the photographer in collaboration with MSF Switzerland photo
editor, shall be made up of at least 40 photographic documents in colour, which shall all be
delivered by the photographer to MSF as JPG files with complete English embedded captions
at high resolution to MSF by May 5, 2016 at the latest.
MSF has the right to consult the entire photographic report including images that are not part
of the final selection.
Article 2 – Copyright
As the report is the result of spontaneous collaboration, the photographer non-exclusively
transfers to MSF, which accepts, the rights of reproduction and communication to the public
associated with the photographs delivered.
They are valid for all MSF publications, MSF websites, MSF social media, slideshows
fundraising materials including exhibitions, posters, etc. related to MSF activities.
MSF gives the photographer exclusivity to pitch his report to the media for ten days. Starting
9.5.16, these images can also be sent freely to external media for MSF communications
worldwide starting. These images will be stated as “all uses” on the MSF international photo
database, which is available throughout the MSF movement.
The photographer undertakes not to give authorisation for reproduction of those images to
third parties who would clearly make use of them in a way which could be detrimental to
MSF’s action and image. Also, if giving authorisation to reproduce by third-party, captions
provided have to first be cleared by MSF and clearly mention that the images were captured
in the context of MSF activities in Irak.
MSF expressly recognises that it is not the holder of the photographer’s moral rights, nor
copyrights. Consequently, the name of the photographer shall be mentioned in all

Article 3.1 – Fees
It is agreed that no fee will be paid to the photographer for these images rights.
Article 3.2 – Expenses
MSF undertakes to cover the transport costs (travel inside Iraq) to the place where the report
is to be photographed.
MSF undertakes to provide logistical support (housing, car, translator, electricity) at the place
where the report is to be photographed.
MSF undertakes to cover the accommodation expenses of the photographer (the photographer
will be accommodated in an MSF house; if this is not possible, MSF reserves the right to
choose another accommodation such as a hotel room).
No other expenses will be reimbursed.
Article 4 – Insurance
No health or repatriation insurance will be provided to the photographer; it is the sole
responsibitiliy of the photographer to be insured.
Equipment insurance is the sole responsibility of the photographer.
The photographer undertakes not to sue MSF in the event of an accident, injury or any other
health problem that may occur during or as a result of the trip.
Article 5 – Material & Photo Equipment
The photographer will provide and use his own technical photographic equipment & material
necessary to produce this photographic order. MSF is not responsible for any loss or damage
to the equipment & material.
